Ohio’s law mandating an abstinence-focus in school sexuality education (ORC 3313.6011) is extremely beneficial to children and families and it’s important that schools follow this law. But how closely do schools stick to the law and its provisions?
For the second year, the Ohio Department of Education (now Education and Workforce) conducted an audit about compliance. ODEW finds that 607 schools are compliant, 2 non-compliant, and 2 exempt.
We disagree. The standards of the law are clear and it’s also clear that many schools are shortchanging students by normalizing high-risk sexual behavior.
We call on the ODEW to monitor and evaluate Ohio schools on their actual compliance with the law going forward. A much more thorough evaluation needs to happen.

3. NON- COMPLIANT districts--School districts flagrantly reporting use of material/curricula that are known to be anti-abstinence, normalizing high-risk sexual behaviors to students.
ODEW may label these compliant, and some did response “yes” to both questions 2 a and b, if they chose to teach “something other than the law” and/or notified parents.
But ODEW did not ask the right question here. Parental notification is not sufficient to follow the law-- written parental CONSENT must be obtained. Would most parents consent if they knew the age- inappropriate details of many of these lessons, including condom demonstrations using plastic models and ways to “protect” teen sexual activity? This is not abstinence.
To responsibly teach an abstinence-until-marriage emphasis, a curriculum must not undermine that emphasis by teaching condom use, contraceptive “protection” in detail, independent sexual consent rights even for young adolescents and normalization of high risk behaviors like anal sex and so-called gender transition.
